قال تعالي

وَاسْتَشْهِدُوا شَهِيدَيْنِ مِنْ رِجَالِكُمْ فَإِنْ لَمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ أَنْ تَضِلَّ إِحْدَاهُمَا فَتُذَكِّرَ إِحْدَاهُمَا الْأُخْرَى [البقرة:282]

الكتابة والإشهاد، ضمانٌ لحقوق العباد، فإن ما تطول عليه الآجال، قد يتعرَّض للجَحْد أو النسيان والإهمال، حفظت شريعةُ الإسلام الحقوق، وأقامت العدلَ بين الخلق؛ فجعلت الشهادةَ في الأموال إمَّا برجُلين أو رجُلٍ وامرأتين، وأمضَت السنَّة الشاهدَ مع اليمين، وشرطَت العدولَ المرتضى دينُهم وصلاحُهم، تفضيل الرجُل على المرأة في الشهادة على الأموال شريعةٌ في كتاب الله، مَبناها على الاحتياطِ للحقوق، لا امتهانِ المرأة وانتقاصِها كما يزعم الجاهلون، تلبية الدعوة للشهادة واجبٌ لا تطوُّع، وفرضٌ لا تفضُّل، فلا ينبغي التأخُّر عنها أو التقاعُس في أدائها

وروى البخاري عن أبي سعيد الخدري ومسلم عن ابن عمر

واللفظ له أن النبي صلى الله عليه وسلم قال: ..ما رأيت من ناقصات عقل ودين أغلب لذي لب منكن، قالت امرأة: يا رسول الله، وما نقصان العقل والدين، قال: أما نقصان العقل فشهادة امرأتين تعدل شهادة رجل فهذا نقصان العقل، وتمكث الليالي ما تصلي وتفطر في رمضان فهذا نقصان الدين

وهي غير ملامة في هذا النقص لأنها غير قادرة على دفعه

وقد أشار الله تعالى إلى وجه ضعفها في الشهادة بقوله: أَنْ تَضِلَّ إِحْدَاهُمَا فَتُذَكِّرَ إِحْدَاهُمَا الْأُخْرَى، فقد تنسى عند أداء الشهادة فتذكرها الأخرى، ولذلك لا يحق للقاضي التفريق بينهما عند الشهادة

على موقع جمعية انقطاع الطمث في أمريكا الشمالية (NAMS) فإن ذاكرة المرأة ليست ثابتة طوال حياتها، بل تتراجع فجأة بعد انقطاع الطمث، إلا أن ذاكرة النساء في منتصف العمر أفضل من ذاكرة الرجال، ولكن بشكل مختلف عن الرجال.

الدراسة الثانية

وفي دراسة أخرى نُشرت في مجلة JNeurosci، وُجد أن المرأة تتذكر الأشياء بشكل مختلف عن الرجل، وأن ذاكرتها العاطفية أقوى من ذاكرة الرجل، أي أنها تتأثر عاطفيًا وبشدة أثناء تذكر الحدث، لأن ذاكرة المرأة أثناء شهادتها تعتمد على نوع التذكر.

الدراسة الثالثة

أجرت جامعة بنسلفانيا دراسةً واسعةً شملت 949 دماغًا لذكور وإناث. ووجد الباحثون أن النساء يتفوقن على الرجال في التفكير متعدد المهام، إذ يستخدمن كلا جزئي الدماغ كما هو الحال في القضايا التي تتطلب التركيز. ففي قضيةٍ واحدة، يتفوق الرجل على المرأة لأنه يستخدم جزءًا واحدًا فقط من الدماغ، كما يقول علماء كلية الطب بجامعة بنسلفانيا. ومن نتائج هذه الدراسة، يقول الدكتور روبن غور: "كانت النتائج صادمة عندما رأينا هذه الاختلافات المذهلة بين أدمغة الذكور والإناث، لكنها مُكمِّلة لبعضها البعض، ولكن المهم هو أن النساء لديهن قدرة أعلى من الرجال على المهام الاجتماعية، بينما يتميز الرجال بقدرتهم الفائقة على العمل الذي يتطلب تركيزًا محددًا، مثل القيادة والتحكم".

نستنتج مما يلي

1- كل هذا يؤكد أن وجود امرأة أخرى أثناء الإدلاء بالشهادة سيكون له تأثير جيد على جودة الشهادة ودقة المعلومات التي ستقدمها، لأن المرأة الثانية غالبًا ما لن يكون لها نفس التأثيرات العاطفية على نفسها. وهذا يُمكّن القاضي من الربط بين شهادة المرأة الأولى وشهادة المرأة الثانية لمعرفة الحقيقة.

2- بما أن المرأة تستخدم عواطفها في التذكر، وبما أن المرأة تعاني من مشاكل في الذاكرة بعد انقطاع الطمث مباشرةً، وبما أن المرأة تستخدم نصفي دماغها للتذكر، مما يعني أنها لا تستطيع التركيز، فمن أجل كل هذا، خفف الله عبء الشهادة عن المرأة وشرفها بتمكينها من استشارة امرأة أخرى لإتمام الشهادة.

3- ولكي لا يتحكم بها الرجال( أي الإستئثار بالشهادة دون المرأة) أوجب الله تعالي هذا الحكم، أي لا تُقبل شهادة المرأة الوحيدة إلا في حالات خاصة، كشهادة الزوجة على زوجها وقضايا العفة والشرف، فهل نقول بعد هذه الحقائق إن الإسلام أهان المرأة وأهانها؟

God Almighty said

وَاسْتَشْهِدُوا شَهِيدَيْنِ مِنْ رِجَالِكُمْ فَإِنْ لَمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ أَنْ تَضِلَّ إِحْدَاهُمَا فَتُذَكِّرَ إِحْدَاهُمَا الْأُخْرَى [البقرة:282]

And bring to witness two witnesses from among your men. But if there are not two men, then a man and two women from among those whom you accept as witnesses, so that if one of them errs, the other may remind her. [Al-Baqarah: 282]

The writing and witnessing guarantee the rights of people, for what is subject to long periods may be exposed to denial, forgetfulness, or neglect. Islamic law preserves rights and establishes justice among people. It makes testimony in matters of wealth either by two men or by a man and two women. The Sunnah has established the witness with an oath, and stipulated that just men be accepted for their religion and righteousness. Preferring men over women in witnessing matters of wealth is a law in the Book of God, based on precaution for rights, not the humiliation and disparagement of women as the ignorant claim. Responding to the call to witness is a duty, not a voluntary act, and an obligation, not a favor. Therefore, it should not be delayed or neglected.

Al-Bukhari narrated on the authority of Abu Sa'id al-Khudri and Muslim on the authority of Ibn Umar

The wording is his: The Prophet, may God bless him and grant him peace, said: "I have not seen anyone deficient in intelligence and religion who has more power over a man of understanding than you." A woman said: "O Messenger of God, what is deficient in intelligence and religion?" He said: "As for deficient in intelligence, the testimony of two women is equal to the testimony of one man. This is deficient in intelligence. And spending nights without praying and breaking the fast in Ramadan is deficient in religion"

She is not to blame for this deficiency because she is unable to prevent it

God Almighty has indicated the weakness of her testimony in His words: "Lest one of them should forget, and then one of them should remind the other." She may forget while giving testimony, and the other may remind her. Therefore, the judge has no right to separate them when giving testimony
